On the 29th December 2009 the current European Machinery Directive (98/37/EC) will be replaced by the 'New' Machinery Directive (2006/42/EC). There will be no transition period where both the old and new directives are applicable. All apparatus that falls within the scope of the Machinery Directive and is placed on the market on or after 29th December 2009 will need to conform to the new regulations from that date onwards.
The change applies to both new and existing products. If a manufacturer intends to continue placing a product on the market within Europe beyond the 29th December, 2009, they must demonstrate that it meets the requirements of the new Machinery Directive, even if it was previously declared to be in conformity with the old regulations.
Compliance Documentation, such as Technical Files, Declarations of Conformity and Declarations of Incorporation for products certified under the old Machinery Directive (98/37/EC) will need to be updated to meet the requirements of the new regulations.
In certain cases where a product has been declared in conformity with the old regulation using a 'special attestation process', such as an EC Type Examination by a Notified Body, a formal update process must be completed in order to show compliance to the new Machinery Directive.
With no transition period between the old and new Directives, it is vitally important that Manufacturers begin preparing for the change in regulations as soon as possible. Under the terms of the regulations it is acceptable for Manufacturers to begin assessing their products against the requirements of the new Directive, so that all the necessary evidence of conformity is prepared and available by the 29th December 2009.
